A man accused of brandishing a machete during an alleged car hi-jacking in Ennis replied to a garda charging him with dangerous driving, “Pity I didn’t drive into you.”
The dangerous driving charge was one of seven new charges brought against Declan Sherlock at Ennis District Court last Wednesday.
Mr Sherlock (22), with an address at Dromard, Ennis, already faced six charges arising from his alleged violent seizure of a neighbour’s car in Dromard last December.
Those old charges include unlawfully seizing control of a car at Dromard, Ennis on December 21, by threat of force, contrary to Section 10 of the Criminal Law Jurisdiction Act 1976. The charge alleges Mr Sherlock threatened to use a machete to stab the male driver.
He is also charged with having a machete with a 29cm blade intended to intimidate a person by threatening to stab the driver if he did not hand over the car keys. That alleged offence is contrary to Section 9 (5) of the Firearms and Offensive Weapons Act 1990. Mr Sherlock is further charged with dangerous driving; driving without insurance and driving without a driver’s license at Carrigoran, Newmarket on Fergus.
He is also charged with dangerous driving at Ballycasey, Shannon.
In court last week, Garda Brendan Keane of Ennis Garda Station gave evidence of the arrest, charge and caution of Mr Sherlock on seven new charges. In his evidence, Gda Keane told the court of the individual replies Mr Sherlock made to each charge after caution.
In reply to the charge of threatening to kill or cause serious harm to the owner of the car he is alleged to have hi-jacked at Dromard, Ennis on December 21, 2017, Declan Sherlock said, “Fuck you, pig’s bastard.”
In reply to the charge of producing a machete while committing a hi-jacking, Mr Sherlock said, “Fuck you.”
Replying to a charge of dangerous driving at Drumline on December 21, 2017, Mr Sherlock said, “Pity I didn’t drive into you.”
Replying to a charge of dangerous driving at Clonmoney on the same night, Declan Sherlock said, “You pig’s bastard.”
After being charged with endangerment at Carrigoran, Newmarket on Fergus on December 21, Mr Sherlock replied, “Fuck you, you corrupt bastard.”
In reply to driving under the influence of an intoxicant at Carrigoran, Newmarket on Fergus, on December 22, 2017, Mr Sherlock said, “You government rat.”
Replying to a charge of criminal damage to a car at Carrigoran, Newmarket on Fergus, on December 21, 2017, Mr Sherlock said, “Fuck you and fuck him the foreign bastard.”
Inspector Tom Kennedy said that with respect to the indictable matters against Mr Sherlock, those charges are to proceed on indictment to Ennis Circuit Criminal Court.
The court heard a book of evidence is being prepared. Declan Sherlock was remanded in custody to appear again at Ennis District Court on March 7, 2017.
